TERMS & CONDITIONS

WHO WE ARE

We are Channel Fight Limited, a company incorporated and registered in England and Wales with company number 10422068 and whose registered address is at Bennett Brooks, Suite 345, 50 Eastcastle Street, London W1W 8EA ("we", "our", "us").

THESE TERMS

These terms and conditions (“Terms”) govern your relationship with us when you access our streaming service located at www.channelfight.com (“Service”) and stream any fight or other event ("Event") via the Service.

By accessing the Service and/or streaming an Event you agree to be bound by these Terms.

CHANGES TO THESE TERMS

At any time, we may amend these Terms to ensure that we remain compliant with relevant laws and regulations and to ensure that we are constantly improving your experience using the Service.

Please check this page from time to time to take notice of any changes we made. By continuing to use the Service after changes are made, you are accepting those changes and will be bound by them.

REGISTRATION

You do not have to register to the Service, but access to certain of the Service functions, including access to Events, is only available to users who register to the Service.

To register, you will need to either register using your Facebook, Twitter or Google account or complete a simple registration process by providing certain information (including your name and email address) and choose a password for use in connection with your use of the Service. 

You agree that you will provide truthful and accurate information when registering on the Service. The decision to register a password is in our discretion and we may revoke your password at any time.

You are responsible for maintaining the confidentiality of your password and account information, and you are responsible for all activities that occur under your password or account and for any access to or use of the Service by you or any person or entity using your password, whether or not such access or use has been authorised by you.

You must immediately notify us of any unauthorised use of your password or account or any other breach of security relating to the Service. We will not be liable for any loss or damage whatsoever resulting from the disclosure of your username and/or password contrary to these Terms.

You are responsible for ensuring that the information we hold about you is up to date. Please amend your details as appropriate from time to time as appropriate.

THE SERVICE AND EVENTS

You may access the Service via one internet-connected hardware viewing device ("Device") at any time.

Events may be accessed on a 'pay per view' basis via the Service.

To access an Event you must be aged 18 or over, have a working broadband connection, and possess a Device.

Access to an Event begins at the advertised start time published on the Service (or any other time that we may notify you of in accordance with these Terms) and finishes 24 hours later.

The Service is provided for your non-exclusive and non-commercial use only.

You must not access or use the Service for any improper or unlawful purpose and you must not allow anyone else to do the same.

DEVICES AND INTERNET CONNECTION

The Service can be accessed via a range of internet-connected hardware Devices. You must ensure that your Device(s) meet(s) the minimum hardware, systems and software requirements (including the requirements for watching streamed HD content, if applicable) to receive the Service. These requirements are:

MINIMUM WINDOWS REQUIREMENTS

Pentium III 1GHz or higher or equivalent AMD processor with a minimum of 512MB of memory.

One of the following operating systems: Windows 7, Windows XP, Windows Vista, or Windows Media Centre Edition Microsoft Internet Explorer 6 with Service Pack 2 or above or Firefox v1.5 or above:

Video adapter and monitor: Super VGA (1024x768) or higher.

To stream an Event your Device must be connected to broadband with a minimum broadband connection of at least 800 kbps. The ability to view an Event may be impacted by the speed of your internet connection. We recommend 3.0 mbps for optimal viewing. You should contact your ISP if you experience any streaming difficulties. Please be aware that content streamed to a Device will count towards any broadband usage limits that apply to your broadband service. You are responsible for any charges associated with exceeding those limits.

PRICE AND PAYMENT

Our prices are set out on the relevant page(s) of the Service and may change from time to time. Our prices include VAT (where applicable) and any applicable sales tax. You pay the quoted price whatever the applicable rate of VAT.

Your payment card will be charged the full advertised price of access to the Event when you confirm your order via the Service ("Order").

Payment processing will be provided on our behalf by InPlayer Ltd. During the Order process you will need to provide InPlayer with information required to collect payments. You authorise InPlayer to collect payments on our behalf. By paying using your credit or debit card you confirm that the card is yours and that there are sufficient funds or credit available to cover the relevant charges.

If a payment processing error is discovered we will use reasonable endeavours to rectify the problem. However, we will not be held responsible or financially liable for any processing errors or delays.

If we reimburse you for any reason we will reimburse the payment card you used in relation to your Order.

INTELLECTUAL PROPERTY RIGHTS

The Service and all material published on or via the Service including but not limited to the Event footage and all other text, graphics, photos, logos, button icons, images, trade marks, audio and audio visual clips, databases, data compilations and  data (together the "Service Content") is owned and controlled by or licensed to us.

Except as permitted under the Copyright, Designs and Patents Act 1988 (the "Act") you must not do (or allow to be done) any of the following:

  • copy, reproduce, share, publish, republish, re-distribute, post, broadcast, frame, transmit, or otherwise use or exploit the Service Content save as enabled and permitted by the Service and these Terms from time to time;
  • copy, publish or re-publish, post, transmit, reverse engineer, decrypt, decompile, disassemble, alter or commercially exploit any software which we allow you to use or access in order to provide the Service;
  • sell, sub-license or make any charge for watching or using the Service or any Event (or any part of them) on any device or otherwise use, share or exploit the Service Content for any commercial, business, or monetised purpose whatsoever; or
  • show any Event (or any part of any Event) in public or authorise or assist anyone to do so, even if no charge is made.

OUR RESPONSIBILITY FOR LOSS SUFFERED BY YOU

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We provide the Service for domestic and private use only. You agree not to use Service for any commercial or business purposes, and we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

You accept and agree we will not be liable for any harmful effect that accessing the Service may have on you, and you agree that you access the Service at your own risk and that we will not be responsible for any liabilities arising from:

  • your unauthorised use of the Service;
  • any fault in your Device or other receiving equipment you use;
  • ending, suspending or restricting the Service or any part thereof in accordance with these Terms;
  • any fault with a broadband service provided by a third party used to deliver an Event to your Device;
  • any delay, failure, content alteration or act in relation to the provision of the Service and/or the Event caused by factors outside our control including but not limited to severe weather conditions, epidemic, civil disorder, terrorist activity, war and government action;
  • errors, viruses or bugs present in or arising from your use of the Service (save to the extent caused by our failure to use reasonable care and skill);
  • incompatibility of the Service with any other software or hardware (including Devices); or
  • interruption or delay in the performance of our payments system.

CHANGES TO THE SERVICE AND EVENTS

We may change the Service or end it at any time.

Events may be rescheduled, cancelled, withdrawn or modified at any time. If an Event you have paid to access is rescheduled, cancelled or withdrawn, we will advertise the change or cancellation on the Service and endeavour to notify you via email.

If we cancel or withdraw an Event for which you have paid for access we will issue you with a full refund of sums paid by you for access to such Event.

If we end the Service and you have paid for access to Events which have not yet taken place, we will issue you with a refund of sums paid by you for access to such Events.

TERMINATION OF YOUR RIGHTS

We may refuse your Order and/or we may terminate your rights under these Terms and disable your access to any Event and/or the Service without refunding or compensating you if:

  • you breach these Terms;
  • we suspect you may be committing a fraudulent activity; or
  • you have acted towards our staff or agents in a way we consider unacceptable.

If we terminate your rights under these Terms, you must immediately stop all activities authorised by these Terms, including your access to the Service.

AVAILABILITY OF THE SERVICE

The Service is provided on an "as is" basis. We make no representations, warranties or guarantees of any kind regarding the availability or operation of the Service, or that the Service will be secure, uninterrupted or free of defects.

Your access to the Service may be suspended or restricted occasionally to allow for maintenance, repairs, upgrades, or the introduction of new functions or services. We will try to limit the frequency and duration of any planned disruption but we will not be liable to you if for any reason the Service is unavailable at any time or for any period.

YOUR STATUTORY RIGHT TO CANCEL

You have the statutory right cancel your Order at any time within fourteen (14) days beginning on the day we email you to confirm your Order (the Cooling-Off Period), but ONLY IF you have not yet started to stream the relevant Event. As soon as you start to stream the Event, your statutory right to cancel your Order will be lost.

If you have not started to stream the Event and you wish to exercise your statutory right to cancel your Order, please contact us at support@inplayer.com within the Cooling-Off Period and we will process a full refund of sums paid by you in respect of the relevant Order.

WEBSITES WE LINK TO

The Service may offer links to other websites from which third party services can be obtained and which we reasonably believe to be reputable sources of such services. However, you acknowledge that these other websites are independent from us and we make no representations or warranties as to the legitimacy, accuracy or quality of such third party services, and we do not accept any responsibility for their content, safety, practices or privacy policies.

COMMUNICATION BETWEEN US

If we need to contact you we will do so electronically using the contact details you provided when you registered to the Service (if applicable) so please ensure you have provided accurate and up to date contact details.

If you wish to contact us for any reason, or if any condition in these Terms requires you to give us notice in writing, you can contact us by email at support@inplayer.com.

OTHER IMPORTANT TERMS

We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms.

If we do not enforce our rights against you, or if we delay in doing so, that does not mean that we have waived our rights against you, and it does not mean that you are relieved of your obligations under these Terms. If we do waive a breach by you, we will only do so in writing, and that will not mean that we will automatically waive any later breach by you.

Each of the terms and conditions of these Terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining terms and conditions will remain in full force and effect.

These Terms are governed by English law and the courts of England and Wales have non-exclusive jurisdiction.
